English

Objective: The proliferation of autonomous artificial intelligence systems has simultaneously destabilized three fundamental presuppositions of traditional civil liability: the attribution of a harmful act to a determinate human agent, the predictability of that agent's behavior, and the injured party's capacity to prove causation. The objective of the present study is to conduct a comparative assessment of the responses of two legal systems. Iran and the European Union to this challenge and to propose an indigenous model for Iranian law.
Method: The research method is descriptive-analytical and comparative, grounded in the analysis of EU Directive 2024/2853, Regulation 2024/1689, the fate of the draft AI Liability Directive, and Regulation 2026/1744 on the one hand, and the rules of itlāf (destruction), tasbīb (causation), lā ḍarar (no harm), the Civil Liability Act of 1960 (1339 SH), and the Consumer Protection Act of 2009 (1388 SH) on the other. This method facilitates a systematic comparison between the two legal systems and the identification of their shared and specific lacunae.
Results: The findings indicate that the European Union, following the official withdrawal of the draft AI Liability Directive in October 2025, has retreated from the special liability rule model and shifted toward a hybrid model of ex ante regulation, strict product liability, and evidentiary presumptions a model that leaves unaddressed the liability of deployers, non-embedded services, and non-material damages. This finding suggests that neither of the two legal systems under examination has formulated a comprehensive framework capable of addressing all dimensions of liability arising from autonomous artificial intelligence.
Conclusion: The article, in conclusion, proposes a risk-proportionate layered liability model in four layers, presents its six-article text, and demonstrates its compatibility with jurisprudential foundations. This model, by distributing liability among the various actors in the AI chain on the basis of their degree of risk and control, facilitates more equitable compensation for damages and can serve as a basis for legislation in the Iranian legal system.
