Research Objective: This research aims to investigate the relationship between the "Persistence Theory in Delinquency" and the effects of the implementation of the "Single Supplementary Article Approved on 3/8/1396" in the field of drug crimes in Iran. The main objective is to explain the effect of this criminal amendment on the continuation or modification of the cycle of criminal behavior and to examine its role in strengthening or weakening the persistence theory.
Research Method: This study was conducted with a descriptive-analytical method and using library resources including criminology texts, criminal laws, and documents related to criminal policymaking in Iran. Data and concepts related to the persistence theory and the aforementioned amendment were analyzed.
Findings: The results of the study show that although the 1396 Single Article has taken a step towards reducing human and social costs by reducing severe punishments (such as limiting the scope of the death penalty), the lack of attention to the mechanisms of rehabilitation and resocialization of criminals has caused the cycle of crime to continue among drug offenders. This, in turn, strengthens the hypotheses of the “theory of persistence in delinquency”.
Conclusion: Simply reducing punishments without comprehensive planning for the rehabilitation of criminals cannot sustainably prevent recidivism. Therefore, in order to break out of the vicious cycle of stabilizing delinquency, it is necessary to improve Iran’s criminal policy through a logical combination of punishment with corrective and resocializing solutions. Finally, practical suggestions are presented in this regard.
