امکان محکوم نمودن افراد به قتل عمدی با وجود عدم ارتکاب فنی (مقایسه تطبیقی حقوق کیفری ایالات متحده آمریکا با حقوق کیفری ایران)

چکیده
هدف: توجه به ارتکاب فنی جرم قتل عمدی که عبارت است از هرگونه رفتار منتهی به مرگ دیگری (عنصر مادی) همراه با تعمد کیفری در انجام آن (عنصر روانی)؛ با هدف پرداختن به اینکه حقوق کیفری آمریکا و ایران در چه مواردی با وجود فقدان این جنبۀ فنی، محکومیت افراد به قتل عمدی را جایز می­دانند.
روش پژوهش: پژوهش کنونی به روش توصیفی تحلیلی و با مراجعه به دکترین، قوانین و آرای حقوق کیفری دو کشور مورد تطبیق به انجام رسیده است
یافته‌ها: یافته ­های پژوهش نشان می­دهند که:
1. در حقوق کیفری ایران، امکان محکوم کردن افراد به قتل عمدی در صورتی که به لحاظ فنی مرتکب این جرم نشده باشند، وجود ندارد.
2. در حقوق کیفری آمریکا، بر پایۀ دکترین قتل عمدی جنایی، می­توان افرادی را که به لحاظ فنی مرتکب قتل عمدی نشده­اند، با این اتهام محکوم نمود.
3. تمسک به دکترین قتل عمدی جنایی در موارد عدم ارتکاب فنی، رویکردی فراگیر در آمریکا نیست و برخی ایالت­ها از آن فاصله گرفته­اند.
4. در موارد عدم ارتکاب فنی قتل عمدی، دکترین قتل عمدی جنایی ممکن است در سه فرض عدم وجود قاتل، قاتل بودن شریک جرم و قاتل بودن شخص ثالث به کار گرفته شود.
نتیجه‌گیری: با آنکه ارتکاب رفتار منتهی به مرگ، اصولاً از سوی محکوم به قتل بایسته به نظر می­رسد، نظام کیفری آمریکا، برخلاف نظام کیفری ایران، در مواردی با تمسک به دکترین قتل عمدی جنایی این بایستگی را نادیده می­گیرد و کسانی را که عملاً و به لحاظ فنی مرتکب کشتن انسان دیگری نشده­اند، به اتهام قتل عمدی محکوم و مجازات این جرم را بر ایشان اِعمال می­نماید.

چکیده English

Objective: To consider the technical perpetration of murder, which is any behavior that leads to the death of another (Actus Reus) along with criminal intent (Mens Rea); with the aim of addressing in which cases the criminal laws of the United States and Iran allow the conviction for murder despite the lack of this technical aspect.
Method: The current research utilized a descriptive-analytical method and refered to the doctrine, laws, and criminal law decisions of the two countries under comparison.
Results: The research findings show that:
1. In Iranian criminal law, it is not possible to convict individuals for murder if they have not technically perpetrated.
2. In American criminal law, based on The Felony-Murder Doctrine, individuals who have not technically perpetrated murder can be convicted of this charge.
3. Relying on The Felony-Murder Doctrine is not a widespread approach in America, and some states do not apply it in such cases.
4. In lacking of technical perpetration of murder, The Felony-Murder Doctrine may be applied in three assumptions: "no murderer", "the murderer being an accomplice", and "the murderer being a third party".
Conclusion: Although the intentional behavior leading to death principally seems to be necessary for a murder conviction, the American criminal system, unlike the Iranian criminal system, in some cases ignores this necessity by applying The Felony-Murder Doctrine and convicts those who have not actually and technically perpetrate the killing of another human being on charges of murder and punishes them for this crime.
