چکیده
هدف: هدف اصلی پژوهش حاضر آن است که با دقت نظر به ساحات ادبی عصر مشروطه، به تحلیل و فهم رگه­هایی از فکر و تلقی از مشروطه­گرایی در متن حقوق عمومی بپردازد. از این رو، هدف تبعی این پژوهش می­تواند زمینه را برای فهم بهتر برداشت­ها و دیدگاه­ها پیرامون دورة مشروطه در نظم حقوق اساسی ایران، تا حدودی مهیا کرده و از این حیث واجد تازگی باشد.
روش پژوهش: این پژوهش با رویکردی تحلیلی- توصیفی و با بهره­گیری از رهیافتی تاریخی به واکاوی دو منظر شعر و نثر در عصر مشروطه می پردازد. این رو، در مقالة پیش رو با درنگی در مفهوم حکمرانی مشروطه و تأملی گذرا در چیستی و عناصر وجودی دولت مشروطه، به دو ساحت مهم ادبی آن عصر (شعر و نثر مشروطه) می­پردازیم که اندیشمندان دوران مورد نظر، برای بیان آرا و نظرات خود و انتقال معنای به عموم مردم، بدان تمسک می­جستند.
یافته‌ها: یافته­های تحقیق نشان می دهد که بارقه های فکر قانون خواهی و مشروطه­گرایی، در زمانه پیش از رویداد مشروطه، نخستین بار در قالب اشعاری نغز و پر مغز و مبتنی بر شور و احساس، و همچنین در قالب نمایشنامه­ها، رساله­های کوتاه، بیانیه یا شرح خاطرات، تجلی و ظهور و بروز یافته است و هر یک از این آثار به گونه­ای در انتقال افکار و ذهنیات مشروطه خواهان موثر افتاده است. ایده­های برآمده از متن نظریات سیاسی و حقوقی با هر منطق و سنجه­ای که ملاک بگیریم، به نوعی با ساحت ادبیات و ظرایف و مضامین متون نظم و نثر فارسی گره می­خورند.
نتیجه‌گیری: نتایج برآمده از تحقیق روشن می­سازد که در واقع فهم انگاره­ها و ایده­های حقوق عمومی مادام که با ذوق ادبی و حکایات و مثال­هایی از تاریخ ادبیات و ریشه های کهن پیوند نخورد، به درستی ادراک نمی­شود و حاصلی مبتنی بر واقعیت­های حقوقی نخواهد داشت.

Reflection of the idea of power and governance in the literary field of the Constitutional Era

چکیده English

Objective: The main goal of the present study is to analyze and understand the strands of thought and perception of constitutionalism in the text of public law, by carefully considering the literary fields of the Constitutional Era. Therefore, the secondary goal of this study can provide the ground for a better understanding of the perceptions and views about the Constitutional Era in the Iranian constitutional legal order, to some extent, and in this respect, it is novel.
Method: This research, with an analytical-descriptive approach and using a historical approach, explores the two perspectives of poetry and prose in the Constitutional Era. Therefore, in the following article, with a pause in the concept of constitutional governance and a brief reflection on its nature, we will address the two important literary areas of the Constitutional Era (poetry and prose) that the thinkers of the period in question relied on to express their emotions and opinions.
Results: The findings of the research show that the flashes of legalism and constitutionalism, in the period before the constitutional event, were first manifested and emerged in the form of beautiful and intellectual poems based on passion and emotion, as well as in the form of plays, short treatises, statements or descriptions of memories, and each of these works was somehow effective in conveying the thoughts and mindsets of the constitutionalists. The ideas arising from the text of political and legal theories, regardless of our logic and attitude towards them, are somehow intertwined with the field of literature and the nuances and themes of Persian poetry and prose texts.
Conclusion: The results of the research make it clear that in fact, understanding the concepts and ideas of public law will not be properly understood and will not produce results based on legal realities unless they are combined with literary taste, anecdotes, and examples from the history of literature and ancient roots.
