چکیده
هدف پژوهش: این پژوهش به بررسی بحران‌های موجود در رژیم منع اشاعه تسلیحات هسته‌ای و ضرورت تقویت تلاش‌های بین‌المللی برای مقابله با حملات ضد اشاعه می‌پردازد. هدف اصلی، تحلیل ظرفیت‌های حقوقی و کیفری بین‌المللی نظام عدم گسترش هسته‌ای در چارچوب تحولات دهه اول قرن بیست و یکم است. 
 روش پژوهش: مقاله حاضر با روش توصیفی-تحلیلی، به بررسی اسناد بین‌المللی، توافق‌نامه‌ها، نهادها و هنجارهای مرتبط با منع اشاعه تسلیحات هسته‌ای می‌پردازد. همچنین، رویکردهای پیشگیرانه و بازدارنده در قبال برنامه‌های هسته‌ای کشورهای غیرهسته‌ای و واکنش‌های نظامی ضد اشاعه مورد تحلیل قرار می‌گیرد. 
 یافته‌ها: 
- رژیم منع اشاعه در مدیریت خطرات تشدید تسلیحات هسته‌ای و جلوگیری از توسعه آن توسط کشورهای غیرهسته‌ای با چالش‌های جدی مواجه است. 
- حملات ضد اشاعه پیشگیرانه، اگرچه در چارچوب مقابله با ظهور قدرت‌های هسته‌ای جدید قرار می‌گیرند، اما می‌توانند به بی‌ثباتی و افزایش تنش‌های بین‌المللی منجر شوند. 
- تقویت رژیم موجود منع اشاعه از طریق همکاری بین‌المللی، مذاکره و شفافیت، می‌تواند راهکار مؤثری برای بازدارندگی اشاعه‌گران و کاهش تمایل به اقدامات نظامی مخاطره‌آمیز باشد. 
 نتیجه‌گیری:  با توجه به افزایش حملات ضد اشاعه و تهدیدات ناشی از گسترش تسلیحات هسته‌ای، تقویت رژیم بین‌المللی منع اشاعه از طریق سازوکارهای حقوقی و هنجاری ضروری است. این پژوهش نشان می‌دهد که رویکردهای چندجانبه و دیپلماتیک، در مقایسه با اقدامات نظامی یکجانبه، کارآمدی بیشتری در پیشگیری از اشاعه تسلیحات هسته‌ای دارند.

Reading the Legal and Criminal International Capacity of the Nuclear Non-Proliferation Regime in the Light of the Developments of the First Decade of the 21st Centur

چکیده English

The increasing frequency of counter-proliferation attacks demonstrates the importance of strengthening international non-proliferation efforts. The nuclear non-proliferation regime, as a set of international agreements, institutions, and norms that provide transparency about nuclear weapons capabilities, manage the risks of escalation, and deter non-nuclear weapons states from developing nuclear weapons, is in crisis. Furthermore, while promoting international cooperation, negotiation, and transparency, it provides a normative regime against nuclear weapons and prevents the possession and use of nuclear weapons. Of course, preventive counter-proliferation attacks that target materials, goods, personnel, or infrastructure associated with a nuclear weapons program fall within this framework for states that oppose the emergence of new nuclear powers. Given the trend of non-proliferation of nuclear weapons and the interest shown by a number of actors, there is a need to prioritize strengthening the existing non-proliferation regime to deter proliferators from developing nuclear weapons programs and to deter their adversaries from considering military action or other risky counter-proliferation strategies. Therefore, focusing on developments in the first decade of the 21st century, the article examines the international legal and criminal capacities of the nuclear non-proliferation regime using a descriptive-analytical research method..
