The increasing frequency of counter-proliferation attacks demonstrates the importance of strengthening international non-proliferation efforts. The nuclear non-proliferation regime, as a set of international agreements, institutions, and norms that provide transparency about nuclear weapons capabilities, manage the risks of escalation, and deter non-nuclear weapons states from developing nuclear weapons, is in crisis. Furthermore, while promoting international cooperation, negotiation, and transparency, it provides a normative regime against nuclear weapons and prevents the possession and use of nuclear weapons. Of course, preventive counter-proliferation attacks that target materials, goods, personnel, or infrastructure associated with a nuclear weapons program fall within this framework for states that oppose the emergence of new nuclear powers. Given the trend of non-proliferation of nuclear weapons and the interest shown by a number of actors, there is a need to prioritize strengthening the existing non-proliferation regime to deter proliferators from developing nuclear weapons programs and to deter their adversaries from considering military action or other risky counter-proliferation strategies. Therefore, focusing on developments in the first decade of the 21st century, the article examines the international legal and criminal capacities of the nuclear non-proliferation regime using a descriptive-analytical research method..
