چکیده
افزایش اقدامات سلطه‌طلبانۀ بشر در چند دهۀ گذشته، تحقق رویای دهکدۀ جهانی را به دنبال داشته است. این امر که زیر پرچم جهانی‌سازی صورت می‌گرفت سبب پیدایش اقداماتی شد که هر چند در ذات خود جرم بود اما با تعاریف و دیدگاه سنتی و قراردادی حاکم بر جرایم سنخیتی نداشت و افزون بر آن از نظر عناصر تشکیل‌دهنده، مرتکبان و قربانیان نیز با جرایم سنتی متفاوت بود. حقوق کیفری نیز با نگاهی سنتی به جرم، تنها رفتارهای خلاف قانون را جرم انگاشته و برای آن مجازات تعیین کرده است. این نگرش به جرم رویکردی است مضیق و برپایۀ اصل قانونی بودن جرایم و مجازات‌ها، درحالی‌که نقطۀ مقابل آن، دیدگاه موسعی است که باورمند است جرم، رفتاری بر پایۀ نقض حقوق بشری شهروندان است. محور اصلی این پژوهش که برپایۀ روش روش توصیفی – تحلیلی است واکاوی نقش پدیدۀ جهانى‌سازى در پیدایش جرایمى است که بی‌واسطه یا با واسطه از آن پدید آمده‌اند. به تعبیر دیگر جرایم‌جهانی، آن دسته از سیاست‌ها و شیوه‌های آسیب‌زای نهادها و موسساتی است که به طور خاص محصول نیروی جهانی‌سازی هستند و در ماهیت خود در محیط جهانی رخ می‌دهند. در این پژوهش به جهت گستردگی و اهمیت این جرایم تلاش شده پروایی فراتر از بُعد ملی و بین‌المللی به موضوع شود تا جرایمی که شوربختانه تا کنون مورد غفلت جرم‌شناسان و کنشگران حقوق کیفری واقع شده آشکار گردد. هم چنین ضمن واکاوی نقش جهانی‌سازی در پیدایش جرایم جهانی و ارائۀ تعریفی دقیق، مانع و جامع، پنداشت رایج نسبت به این جرایم اصلاح شود.

چکیده English

The increase in human hegemonic actions in the past few decades has led to the realization of the dream of a global village. This, which was carried out under the banner of globalization, led to the emergence of actions that, although they were inherently crimes, did not conform to the traditional and conventional definitions and views governing crimes, and in addition, they were different from traditional crimes in terms of their constituent elements, perpetrators, and victims. Criminal law, with its traditional view of crime, has considered only illegal behavior as a crime and has determined punishment for it. This view of crime is a narrow approach based on the principle of legality of crimes and punishments, while its opposite is a broad view that believes that crime is behavior based on the violation of the human rights of citizens. The main focus of this research, which is based on the descriptive-analytical method, is to analyze the role of the globalization phenomenon in the emergence of crimes that have arisen directly or indirectly from it. In other words, global crimes are those harmful policies and practices of institutions and institutions that are specifically the product of the force of globalization and that occur in a global environment by their very nature. In this study, due to the scope and importance of these crimes, an attempt has been made to look beyond the national and international dimensions of the issue in order to reveal crimes that have unfortunately been neglected by criminologists and criminal law activists. In addition, while analyzing the role of globalization in the emergence of global crimes and providing a precise, comprehensive and determinative definition, the common perception of these crimes is revised.
