It also seeks to clarify the role of the intellectual and political transformations of this era in preparing the ground for the formation of a law-based legal system.<br><strong>Method:</strong> The research is conducted using a descriptive analytical approach. By tracing the process through which the idea of law took shape in its modern sense, it analyzes the trajectory of the transformation of law and legalism in the legal history of Iran during the pre-Constitutional period. The data have been collected through the study of relevant historical and legal sources and subsequently subjected to analytical examination<span lang="EN">.</span><br><strong>Results</strong>: The results indicate that, in this period, certain intellectuals first engaged in theoretical discussions concerning the concept of law, and subsequently some state officials undertook practical measures to realize legalism. Furthermore, the concept and content of law underwent a transformation that, on the one hand, rested on the continuity of earlier traditions and, on the other, was founded upon the establishment of new principles and frameworks.<br><strong>Conclusions</strong>: Taken together, these developments created significant legal preconditions, the most important outcome of which was the emergence and consolidation of the idea of the rule of law and the expansion of legalism in Iranian society. In addition, this process provided the intellectual and institutional foundations necessary for the acceptance of the constitutional system and the institutionalization of law within the political structure of the country. <strong><span lang="FA">هدف:</span></strong><em> </em><span lang="FA">بررسی روند شکل‌گیری و تحول اندیشه قانون و قانون‌گرایی در دوره پیشامشروطه و تبیین رهیافت‌هایی که این اندیشه در نیم‌قرن منتهی به پیروزی مشروطیت در ایران طی کرده است. همچنین این پژوهش می‌کوشد نقش تحولات فکری و سیاسی این دوره را در زمینه‌سازی برای شکل‌گیری نظام حقوقی مبتنی بر قانون روشن سازد</span><span dir="LTR" lang="EN">.</span><br><strong><span lang="AR-SA">روش پژوهش</span></strong><strong><span lang="FA">:</span></strong><strong> </strong><span lang="FA">این پژوهش با رویکرد توصیفی</span><span lang="FA">–</span><span lang="FA"> تحلیلی انجام شده و با بررسی سیر تکوین اندیشه قانون در مفهوم جدید آن، روند تحول قانون و قانون‌گرایی در تاریخ حقوق ایران در دوره پیشامشروطه را تحلیل می‌کند. داده‌های پژوهش نیز از طریق مطالعه منابع تاریخی و حقوقی مرتبط گردآوری و مورد تحلیل قرار گرفته‌اند</span><span dir="LTR" lang="EN">.</span><br><strong><span lang="AR-SA">یافته‌ها</span></strong><strong><span lang="FA">: </span></strong><span lang="FA">نتایج نشان می‌دهد که در این دوره ابتدا برخی از اهل نظر به طرح مباحث نظری درباره مفهوم قانون پرداختند و سپس تعدادی از رجال حکومتی در جهت تحقق قانون‌گرایی اقدامات عملی انجام دادند. همچنین در مفهوم و محتوای قانون تحولی شکل گرفت که از یک سو بر تداوم سنت‌های پیشین استوار بود و از سوی دیگر بر پایه تأسیس مبانی و قالب‌های جدید استقرار یافت</span><span dir="LTR" lang="EN">.</span><br><strong><span dir="RTL" lang="AR-SA">نتیجه‌گیری</span><span dir="RTL" lang="FA">: </span></strong><span dir="RTL" lang="FA">این تحولات در مجموع زمینه‌های حقوقی مهمی را فراهم ساخت که مهم‌ترین پیامد آن شکل‌گیری و استقرار اندیشه حکومت قانون و گسترش قانون‌گرایی در جامعه ایران بود. افزون بر این، این روند زمینه‌های فکری و نهادی لازم را برای پذیرش نظام مشروطه و نهادینه شدن قانون در ساختار سیاسی کشور فراهم کرد.</span> https://api.lu.ac.ir/article_729769_e36a801c29a1f9cca09772893881c214.pdf
